Oregon Toxics Alliances Healthy Air Oregon is a comprehensive project to protect childrens health by reducing benzene emissions from gas stations throughout Oregon. OTA also recommends steps that individual car owners can take to cut down on the amount of benzene and other hazardous air pollutants from gas tanks and tailpipes.

This is a great law, but what do you do if the attendant insists on topping it off, even after being asked not to. Who handles enforcement and how do we let them know it is happening?

You can inform the attendant that (since July 2009) it is the law NOT to “top off,” and if they persist, you can always complain to the gas station owner. I seriously doubt any attendant is going to push it if you inform them of the law. Enforcement is handled through the Oregon Department of Environmental Quality.
